Section 504 IPC 1860

 








According to Section 504 of the Indian Penal Code, if any person intentionally insults and thereby incites a person, intending or knowing that such incitement may cause him to disturb the public peace or commit any other offence, he shall be punished under Section 506 IPC.  The term of punishment may extend to 2 years with imprisonment of any description or with fine or with both.


What is Section 504 ?? 


As defined in Section 504 IPC Code;  If any person intentionally provokes any person by insult, intending or knowing that such provocation may cause such person to commit a breach of the public peace or commit any other offence.

To better understand IPC 504 it is necessary to know what "insult " actually means and how it becomes of a serious nature that can make a person liable to commit a criminal offence.


      - Section 504 of the IPC aims to prevent intentional use of insulting language amounting to insult, incitement to breach of peace.

This section shows how a person can induce another to commit an offense which is criminal in nature and may seriously injure the public peace.


‌What are the essential elements of IPC 504?


In our daily life also, we hear many words which are offensive in nature but most of the times we expect them, but in this case if using abusive or offensive words to insult or provoke a person, it is an offense under IPC 504 of Indian Penal Code.  

Following are the elements under this section -

      • Accused intentionally insulting someone

      •which is intended to be such as to provoke the person offended 

      • The accused knows that such provocation is likely to disturb the            public peace or under the influence of which he commits an                offence. 


‌What is " Contempt" referred to under Section 504?


"Insult" is necessary to commit an offense under this section. The word insult means that the words used must be of such a nature as to cause humiliation to a person.

For example - 

A insults or provokes B by involving the chastity of B's ​​mother or sister, whereby B commits an offense such act falls under IPC Section 504.

Section 504 of the IPC considers the severity of verbal insult as sufficient to provoke the person insulted.Various court judgments have held that the mere use of offensive words in a common fight does not constitute an offense under Section 504 as it lacks the most essential element of intentional insult. 


The insult must be intentional so as to induce the person insulted to commit a breach of the public peace or commit any other offence. 


Simply put, intentionally provoking or inciting someone to commit an offense or disturbing the public peace is an offense under this section.  This means that intentionally insulting a person to provoke him is an offence.  Thus, this clause protects the dignity of citizens by assuring them that the original law contains provisions that protect the self-respect and dignity of every person living in our country.
